JOHNSON, Judge.

The evidence at the hearing showed the following: On 27 December 1993 at approximately 7:40 p.m., Officer A. N. Robinson of the Charlotte Police Department saw defendant standing in front of Josh’s Convenience Store. Officer Robinson had made nearly fifty arrests at or near Josh’s Convenience Store. As a unmarked police car pulled up, he saw defendant put something in his mouth. Officer Robinson believed the items to be crack cocaine.
