Action by appellee to recover damages on account of personal injuries alleged to have been sustained by him while a passenger on appellant’s interurban car, by reason of negligence on the part of appel lant’s servants in charge of said car, in failing to render him assistance and to protect him in a struggle with a highwayman who had boarded the car. This is the second appeal of the case. See Terre Haute, etc., Traction Co. v. Scott (1926), 197 Ind. 587, 150 N. E. 777, 43 A. L. R. 1029.
