In the information in this case, filed in the district court of Tulsa county, Clifford Hare was charged with the crime of murder, alleged to have been committed in said county on or about the 12th day of November, 1934, upon the body of William Mushrush, by shooting him with a rifle. Upon his trial the jury returned their verdict finding the defendant guilty of manslaughter in the first degree, and assessed his punishment at imprisonment for a term of fifteen years.
