This case is before the Court upon the appeal of Elizabeth Dawn Thornton (hereinafter referred to as “Appellant”) from the *452August 17, 2009,1 final order of the Circuit Court of Kanawha County, West Virginia, in which she was sentenced to an indeterminate sentence of three to 15 years in the state penitentiary for her conviction of child neglect resulting in death, as contained in W.
