This action was brought to recover damages for the alleged wrongful closing of a railroad crossing in the Town of McCormick. The trial resulted in a verdict in favor of respondent for $1,500.00. From the judgment entered thereon, the Railway Company has appealed. The crucial question is whether the crossing was wrongfully closed by the Railway Company or lawfully closed by the Railway Company under authority from the Town of McCormick.
