HAWKINS, Judge.

Conviction is for assault with intent to murder one Allan Marshall, punishment being assessed at confinement in the penitentiary for one year.

Appellant and R. C. Townsend are brothers; R. C. being about thirty years of age and appellant about twenty years of age. The two Townsends, Allan Marshall, with many other persons, attended a dance at the home of Arthur McWilliams on the night of February 16, 1934, at which time the difficulty arose out of which this prosecution grew.
