Charles A. Arbuthnot filed suit against J. P. Elliott and E. J. Brann. He alleged that he was a real estate broker, and had been employed to sell a house and lot belonging to Elliott, and that he procured a purchaser, in the person of B. P’Pool, who was ready, willing, and able to purchase the property upon terms satisfactory to the owner, and in fact said Elliott sold the property to the P’Pools at the price asked, to wit, $4,750. 1-Ie further alleged that E.
