Appeal from a judgment of the superior court for Asotin county, Miller, J., entered May 16, 1907, upon the verdict of a jury rendered in favor of the plaintiff, after a trial on the merits, in an action on contract, establishing a claim against an estate.

The appellant is the administratrix of the estate of Dr. A. J. Smith, deceased. The respondent presented a claim against the estate for $3,000 and interest, averring that'sum to be due for services performed for Dr. Smith in his lifetime, at his special instance and request, as nurse, bookkeeper and housekeeper, between the dates of February. 25, 1898, and February 25, 1903. The claim was rejected by the administratrix, and this suit was instituted to establish the same as a proved claim against his estate.
