The plaintiff’s son was killed on the 13th of May, 1898, while engaged, as a workman, in the erection of a building in the city of Rew York. This action was brought by the plaintiff as the personal representative of the decedent to recover damages under the statute. The owner of the building and a firm of contractors were made defendants, and it is charged that the death was the result of their negligence.
