John A. Shield, the appellant, filed his bill in equity-in the lower court in which he prayed for an injunction to restrain the defendants from erecting, or allowing the erection of, a certain building or structure near the beach or bank of York river, adjacent to the town of York, or Yorktown as commonly known.
