The action is in equity, brought by a surviving executor to follow and reclaim trust moneys converted by a deceased fiduciary.
In September, 1915, John C. R. Eekerson had an account in his own name with the defendant, the Hudson Trust Company. He told Mr. Purdy, one of the defendant’s officers, that he wished to open a second account, which for his own bookkeeping reasons was to be kept separate from the first.
