The defendant was indicted in 1952 for murder in the first degree, then a capital offense. After a jury trial, he was convicted of murder in the second degree and on October 9, 1952, he was sentenced to an indeterminate term of imprisonmént with a minimum of 35 years and a maximum of life. The judgment of conviction was subsequently overturned on appeal to the Appellate Division and a new trial was ordered. (People v. La Ruffa, 2 A D 2d 765.)
