HOUSER, Commissioner.

This is an appeal by Don Roach from a judgment entered on a plea of guilty con victing him of forgery, and from an order overruling defendant’s motion to withdraw his plea of guilty.

Roach was charged with passing and uttering a forged and counterfeit check in the sum of $5 with intent to cheat and defraud.
