Suit was brought by Sims as receiver in bankruptcy, .appointed to take charge of the assets of E. G-. Coffman, who had been adjudged a bankrupt, against the Firemen’s Fund Insurance Company, upon a policy of fire-insurance which had been issued to ■Coffman. By an amendment the name of Sims, trustee in bankruptcy, was substituted for that of Sims, receiver, as a party plaintiff. The case was submitted to the trial judge upon an agreed statement of facts, and he rendered a judgment in favor of the plaintiff, to which judgment the insurance company excepted.
