On August 27, 20071 heard oral argument on three pending motions for summary judgment. My decisions on those motions, and the reasons therefor, are as follows.

1. Defendant Assabet Construction Services, Inc.’s Motion for Summary Judgment (Paper #38).

This motion is DENIED.

There is evidence from which a jury could find that both the owner and Assabet — which had some overlap in ownership and management — held Assabet out as the general contractor on the project, and that the plaintiffs employer (see below) viewed Assabet’s President, Kevin O’Malley, as someone from whom…
