This action was brought to recover upon a bond executed by the defendant to the plaintiff under the following circumstances: Upon March 19, 1914, plaintiff and one John Tompkins, defendant’s brother, entered into a contract by the terms of which *291■Tompkins agreed to supervise á number of canvassers to be hired either by plaintiff or said Tompkins, and to expend moneys necessary for their maintenance and pay them such commissions as were approved by the plaintiff, and to make a house-to-house canvass in a certain territory specified therein, and to secure one year’s subscription to a certain…
