Plaintiff Bath & Body Works Brand Management, Inc., (“BBW”) brought this *390declaratory judgment action against Summit Entertainment, LLC (“Summit”), on March 8, 2011, to establish its right to use the marks Twilight Woods and Twilight Crush for personal care products.1 ECF No. 1.
