DUFRESNE, Judge.

Diversified Services, Inc., d/b/a Budget-Rent-A-Car, and Hector Villafone, a lessee of a Budget automobile, defendants-appellants, bring this appeal from an adverse judgment in favor of Clark D. Matthews, plaintiff-appellee, for damage to his automobile. Matthews has answered, alleging that this appeal is frivolous, and seeks damages pursuant to La.Code Civ.Pro. art. 2164. Because we find that the trial judge *604erred in not finding Matthews partially at fault in causing the accident, we amend the judgment to so provide.
