It appears by the record in this case that the defendants in error sued T. Hill, junior, in the supreme court of this state, in which suit the present plaintiff in error came into that court and entered into a recognizance of bail for Hill in the usual form ; that a recovery was had in that suit against Hill, and an execution against his body returned unsatisfied.
