This action was brought to recover damages for personal injuries to plaintiff, Emile Dozenback, while in defendants’ employ as a miner, caused by the premature explosion of blasting powder, known as the ‘ ‘ Rend Rock ” powder. Under the pleadings of this cause the substantial issues were: First, as to the safety of the Rend Rock powder; second, whether the defendants exercised care in supplying a reasonably safe powder, and permitting the Rend Rock brand to be used by plaintiff; third, whether plaintiff knew, or ought to have known, *452the quality of the powder, and whether he…
