This suit for damages for personal injuries sustained by the minor plaintiff on June 13,1929, was instituted in the Court of Common Pleas No. 4, and has been tried three times. At the first trial a judge of this court entered a compulsory nonsuit, and this was taken off by the court in banc. By reason of the consolidation of the trial lists of the five Courts of Common Pleas of Philadelphia County, the second trial was before a judge of the Court of Common Pleas No. 2, and a compulsory nonsuit was again entered.
