Almand sued the railroad company for $5,000 damages, on account of his alleged wrongful expulsion from one of the defendant’s .trains. He alleged in his petition that on a day named he was the holder of a mileage ticket issued to him by the defendant, which he had bought and paid for, and which provided, among other things, that it should be good for passage on either passenger-trains or way freight-trains.
