Plaintiff in this action seeks to recover his share of profits earned upon the sale of real property, in accordance with an alleged partnership agreement between himself and the defendant. By order dated October 1, 2003 (the prior order), this court denied defendant’s motion for leave to amend his answer, pursuant to CPLR 3025 (b), to allege a seventh affirmative defense of unclean hands based on illegality.
