Lee & Leavitt, on tbe 21st of February, 1867, sued out an attachment in this court, against Thomas C. Butler, for about $47,000, and the plaintiffs became sureties in the undertaking, given by Lee & Leavitt to Butler, to procure the attachment. This undertaking was in double the amount of. the claim, and to the effect that Lee & Leavitt should pay to Butler all damages which he might sustain by reason of the attachment, if the order was wrongfully obtained. 2 S. & C. 1004.
