This action was brought in the superior court of King county to prohibit the county auditor of that county and the election board thereof, from giving notice of a special election to fill a vacancy on the supreme court of this state. To the complaint, a demurrer was interposed and sustained. The relator refused to plead further, and elected to stand upon his complaint. Judgment was entered dismissing the action, and the case was brought here for review by certiorari.
