In this case, the government filed a mul-ticount indictment charging appellant with one count of kidnapping (D.C.Code 1973, § 22-2101); four counts of rape (id., § 22-2801); four counts of sodomy (Id., § 22-3502); and one count of assault with a dangerous weapon (id., § 22-502). On motion by appellant’s counsel at the close of the government’s case, the court acquitted appellant on one count of rape and one count of sodomy.
