In an action to recover damages for medical malpractice, etc., the defendant Rubin Frenkel appeals from an order of the Supreme Court, Kings County (Jones, J.), dated June 28, 2001, which denied his mo*571tion for summary judgment dismissing the complaint insofar as asserted against him.
Ordered that the order is affirmed, with costs.
