Appellants/plaintiffs Russell “Russ” John McGonagil and Ellen McGonagil appeal from the order of the trial court granting summary judgment to appellees/defendants Margarita and Robert Michael Treadwell; the trial court determined appellees had “probable cause” to cause an arrest warrant to issue. This litigation arises from appellees’ swearing out a warrant for the arrest of appellant Russ McGonagil and the filing of a subsequent false arrest suit by him.
