In August 2011, plaintiff Robert Harte was observed by law enforcement leaving a hydroponics store in Nansas City, Missouri with a small bag of merchandise. More than seven months later, that information, along with Mr. Harte’s license plate number, was provided by law enforcement to the Johnson County Sheriffs Office.
