Di Giulio (plaintiff) was injured when a piece of wood framing split and he fell from the roof of a booth he was assembling for use at the 1993 Italian festival organized and operated by defendant Greater Buffalo Italian Heritage and Food Festival, Inc. (Festival). Plaintiff had volunteered to assist in assembling the booth for its owner, defendant John J. Fiorella.
