On April 1, 1936, .plaintiff below, who is plaintiff in error here, filed his declaration in the Circuit Court of Duval County, Florida, against the Atlantic Coast Line Railroad Company, a corporation, who is defendant in error here, in which it was alleged that he received permanent physical. injuries caused by the negligence of the defendant on July 31, 1934, while in its employment.
