Pursuant to Supreme Court Rule 604(a)(1) (210 Ill. 2d R. 604(a)(1)), the Attorney General appealed from the granting of defendant Omar Al Burei’s motion to suppress evidence. As the defendant did not file a brief, the appeal was taken on the Attorney General’s brief only. On December 5, 2006, this court affirmed the granting of the defendant’s motion to suppress in an order pursuant to Illinois Supreme Court Rule 23 (eff. May 30, 2008). People v. Al Burei, No. 1 — 05—0599 (2006) (unpublished order under Supreme Court Rule 23). The Attorney General filed a petition for leave to appeal.
