Appeal from a judgment of the Supreme Court at Special Term (Cholakis, J.), entered December 14, 1981 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of the Commissioner of Health which suspended, for 60 days, petitioner’s license to practice medicine. Petitioner, an Ulster County physician, is engaged in the general practice of medicine of which his obstetrical practice accounts for 20%.
