DAVIDSON, Judge.

In a former appeal of the case growing out of this transaction, the judgment was reversed and the prosecution ordered dismissed (155 Texas Crim. Rep. 81, 230 S. W. 2d 816).

A new indictment was presented in the district court of Hardin County, Texas, on the 28th day of June, 1950, charging appellant with the malicious murder of Cloyce Eloise Twitchell. Upon the court’s motion, the veune of the case was transferred to the district court of Chambers County, Texas.
