The defendant, Kelly Fordham, was charged in three separate indictments with a total of four counts of failure to pay for agricultural products, in violation of former Code Ann. § 5-9914. The offenses were alleged to have been committed in July and August of 1982. Although former Code Ann. § 5-9914 was in effect at that time, it was subsequently repealed by § 1-1-10 (a) (1) of the Official Code of Georgia Annotated, which took effect on November 1, 1982, and the offense was not included in the new Code as originally enacted.
