This is a petition of Joseph Swager praying a writ of mandamus against J. F. Gillham, one of the judges of the circuit court of Randolph county, commanding him to expunge a certain order entered in vacation in a habeas corpus proceeding in the Randolph county circuit court. The petition alleges said Joseph Swager was on July 8, 1914, tried in the criminal court of Cook county for murder, and that the jury found by their verdict he was insane at the time of the commission of the homicide and had not entirely and permanently recovered from such insanity.
