This is a special case stated, in the nature of a bill for specific performance, under the provisions of sec. 184, &c., Art. 16 of the Code. Its object is to obtain the decision of this Court upon the question whether the title to the property sold by the plaintiff to the defendant is a good and marketable fee-simple title, free from liens and incumbrances.
