This proceeding has been engendered by the recent decision of the Supreme Court of the United States in the case of Illinois ex rel. McCollum v. Board of Education, of School Dist. No. 71 Champaign Co. (333 U. S. 203). The petitioner, as a citizen of the United States and a resident of Westchester County, State of New York, has instituted the same under article 78 of the Civil Practice Act.
