The appellant was appointed by the District Court for the District of Kansas as trustee to effect the administration of a court-approved agreement between the debtor-appellee and his creditors entered pursuant to an arrangement under Chapter XIII of the Bankruptcy Act, 11 U.S.C.A. § 1001 et seq. Appellant now complains of an order of the District Court honoring the debtor’s voluntary petition seeking a general adjudication in bankruptcy which was filed while the debtor was within the shelter of the Chapter XIII proceedings and not previously in default.
