Brown sold to Harlan a house and lot in Frankfort, April 1, 1844, at $5,500, to be paid at five years’ date, to bear interest from -date, to be paid yearly, a deed of conveyance to be made on the payment of the purchase price.

*119Numerous payments were made by Harlan, when Batchelor, then a clerk and bookkeeper in the Farmers’ Bank, was requested to state the account and strike the balance from data furnished by Harlan, which he did, showing the remainder due September 1, 1859, to be $3,246.80.
