This is an action to recover the value of a promissory note alleged to have been loaned by the plaintiff to the defendant, an incorporated life insurance company, and wrongfully converted by the latter to its own use.
The petition alleged that'the defendant executed and delivered to plaintiff a certain agreement in writing whereby it *194promised and agreed with plaintiff, etc., a true copy of wbicb •said agreement duly verified was thereto attached filed and made a part thereof.
