OPINION AND ORDER
WILLIAMS, District Judge.
This case is before the court on plaintiffs’ motion for default judgment pursuant to Federal Rule of Civil Procedure 55(b)(2), alleging failure of defendants to answer plaintiffs’ complaint as required by Fed. Rule Civ.Proc. 12(a)(2). Upon defendants’ objection and after a hearing on the matter, *741the court sustains defendants’ objection and herewith dismisses plaintiffs’ motion for default judgment.
