JONES, Presiding Judge.

This is an appeal by the State of Oklahoma from an order of the County Court of Carter County sustaining a motion to suppress evidence, in a case wherein the defendant in error, Oliver Marutsky, was charged with the unlawful possession of intoxicating liquor. The motion to suppress evidence was filed and a hearing had thereon prior to the commencement of the trial. After the conclusion of the hearing upon the motion to suppress evidence the trial court sustained the motion to suppress and dismissed the case from which action the State saved an exception and took the…
