JONES, Justice:

Appellant sued appellee in the Circuit Court of Warren County in an action of tort for personal injuries. The lower court sustained a motion for a peremptory instruction on the ground that appellant was injured as a result of the action of a fellow-servant. On this appeal, we affirm the case.

Appellant was an employee of appellee. At the time of the injuries alleged, appellant was in a motor boat in a canal near the City of Vicksburg for the purpose of determining the defects in an outboard motor, which it was his purpose to repair. Appellant was an outboard motor mechanic. The…
