Plaintiff, Ike Oliver, Sr., beneficiary of a burial insurance policy issued to Eliza Miller by defendant, Reliable Life Insurance Com*1170pany, brought suit to recover benefits provided in the policy. Defendant denied liability on the basis of (1) LSA-R.S. 22:613 which prohibits the procurement of insurance on the life of another unless the benefits are payable to the insured or his representatives or to one with an insurable interest in the insured at the time the contract was made;1 and (2) material misrepresentations concerning the health of the insured.
