1 *1802 *179This cause was submitted at the January, 1895, term of this court, and an opinion was filed May 29,1895, affirming the decree of the lower court. (68 N. W. Rep. 607.) A rehearing was granted at the October, 1895, term, and the case has again been submitted on additional arguments from counsel on either side. We held, in the opinion first filed, that a motion presented by appellee to strike the evidence from the abstract should be sustained.
