Appeal from an order of the Supreme Court (O’Shea, J.), entered December 8, 2009 in Chemung County, which, among other things, granted plaintiffs motion for partial summary judgment.
Defendant Christa Construction, Inc. (hereinafter defendant) entered into a subcontract with plaintiff to perform, among other things, drywall installation. The subcontract provided for a form of alternative dispute resolution (hereinafter ADR).
