OPINION AND ORDER

AIKEN, District Judge.

Defendant moves to dismiss this action pursuant to Fed.R.Civ.P. 12(1) due to lack of subject matter jurisdiction. The motion is granted.

BACKGROUND

On February 22, 1999, plaintiff, a salvage worker, was assigned to supervise a salvage crew on the bow section of the M/V NEW CARISSA. The bow section of the vessel was aground on the beach, in the surf line, off Coos Bay, Oregon.
