MEMORANDUM OPINION AND ORDER

[¶ 1] Defendant, Lamont D. Hill (Hill) was charged by information with contempt of court, in violation of 18 U.S.C. § 401 (a Class B misdemeanor). On September 6, 2000, he pled guilty to the contempt charge, pursuant to a plea agreement, and was thereafter sentenced to four months of imprisonment. Hill appealed his judgment and sentence but because the appeal was not taken in a timely manner, the Eighth Circuit Court of Appeals dismissed the same for lack of jurisdiction.
