Appellant, E. B. Blalock, was indicted for the murder of Lee McG-raw, and was tried and convicted of manslaughter, and sentenced to three years in the penitentiary, from which he appeals.

During the latter part of October, 1925, E. B. Blalock and his son, W. B. Blalock, killed Lee McGrraw. It appears from the record that Lee McGrraw and his brother were traveling along the public highway in a wagon drawn by mules. Blalock and his son came up behind in a truck, and requested McGrraw to give them more road. McGrraw seems to have replied that they…
